Before the storm of removal, the Cherokee Nation stood as a beacon of progress and self-determination. By the early 19th century, they had largely adopted many aspects of American farming and societal structure, not as an abandonment of their identity, but as a strategic adaptation to coexist. Their society was far from primitive; it was a sophisticated republic with a written constitution, a bicameral legislature, and a judicial system. They owned thriving farms, operated mills, and even possessed enslaved people, reflecting the complex, often contradictory, influences of their white neighbors.
Perhaps the most striking testament to their advancement was the invention of a written language. In 1821, a Cherokee scholar named Sequoyah (George Gist) completed his syllabary, a system of 85 characters representing every sound in the Cherokee language. This remarkable achievement allowed for widespread literacy within a few years. As historian Robert Remini noted, "It was a feat unique in the annals of humankind: a language developed by a single individual, enabling an entire nation to become literate in a matter of months." This newfound literacy fueled the establishment of the Cherokee Phoenix, a bilingual newspaper, in 1828, printed in both English and Cherokee, further solidifying their national identity and communication.
Their ancestral lands, sprawling across parts of Georgia, Tennessee, Alabama, and North Carolina, were not merely territory but the spiritual and economic heart of their existence. Here, generations had lived, hunted, farmed, and buried their dead. Their sovereignty over these lands had been affirmed by numerous treaties with the U.S. government, treaties the Cherokee believed to be sacred and binding.
However, the rapid expansion of the burgeoning United States, coupled with the insatiable hunger for land, created an inevitable collision course. The discovery of gold in Cherokee territory in Georgia in 1829 ignited a fever pitch of desire among white settlers and the state government. Georgia, driven by both gold and the cotton kingdom’s demand for land, intensified its efforts to dispossess the Cherokee. It unilaterally declared Cherokee laws null and void, seizing their lands and harassing their citizens, despite federal treaties.
The federal government, under President Andrew Jackson, largely sided with Georgia. Jackson, a veteran of wars against Indigenous peoples, was a staunch proponent of "Indian Removal," believing it essential for national expansion and, ironically, for the "preservation" of Indigenous cultures by relocating them far from corrupting white influences. In 1830, despite fervent opposition from humanitarians and some members of Congress, Jackson pushed through the Indian Removal Act, which authorized the President to negotiate treaties for the removal of Indigenous nations to lands west of the Mississippi.
The Cherokee, led by their Principal Chief John Ross, refused to be intimidated. They fought back through legal means, appealing to the very system that sought to dispossess them. Their struggle culminated in two landmark Supreme Court cases: Cherokee Nation v. Georgia (1831) and Worcester v. Georgia (1832). In Worcester v. Georgia, Chief Justice John Marshall delivered a resounding victory for the Cherokee, ruling that the Cherokee Nation was a "distinct political community" with its own territorial boundaries, and that Georgia’s laws had no force within those boundaries. Marshall affirmed the Cherokee’s right to their land and condemned Georgia’s actions.
Yet, Marshall’s legal triumph was rendered meaningless by executive defiance. President Jackson famously scoffed, "John Marshall has made his decision; now let him enforce it." With the backing of the President, Georgia continued its campaign of harassment, effectively nullifying the Supreme Court’s ruling. This deliberate flouting of the highest court’s authority laid bare the vulnerability of the Cherokee Nation, demonstrating that their rights were subject to the whims of political power.
Against this backdrop of legal victory and political betrayal, internal divisions within the Cherokee Nation grew. A small faction, known as the Treaty Party, led by Elias Boudinot and Major Ridge, believed further resistance was futile. Convinced that removal was inevitable, they sought to secure the best possible terms for their people. Without the authority or consent of Principal Chief John Ross and the vast majority of the Cherokee Nation, the Treaty Party signed the Treaty of New Echota in December 1835. This illegitimate treaty ceded all Cherokee lands east of the Mississippi for $5 million and land in Indian Territory (present-day Oklahoma).
The vast majority of the Cherokee Nation, numbering over 16,000, vehemently rejected the treaty, protesting that it was fraudulent and had been signed by individuals who did not represent them. Principal Chief John Ross traveled to Washington D.C. with thousands of signatures, pleading with Congress to invalidate the treaty. His pleas, however, fell on deaf ears. The U.S. Senate ratified the treaty by a single vote, setting a deadline of May 1838 for the Cherokee to voluntarily move west.
When the deadline arrived, fewer than 2,000 Cherokees had voluntarily relocated. President Martin Van Buren, Jackson’s successor, ordered the enforcement of the treaty. In May 1838, General Winfield Scott and 7,000 U.S. troops, along with state militias, began the brutal task of rounding up the Cherokee people. Soldiers stormed homes, often with little warning, forcing families out at bayonet point. "The property of the Cherokees was plundered, their homes were burned, and their fields were laid waste," recounted one eyewitness. Homes were looted, personal possessions stolen, and families often separated in the chaos.
The rounded-up Cherokees were held in makeshift stockades and concentration camps throughout the summer, enduring squalid conditions, disease, and starvation. Then, the forced march began. Over the course of the next few months, more than 16,000 Cherokee men, women, and children, along with thousands of enslaved Africans held by some Cherokee families, were forced to march more than 1,000 miles, primarily on foot, across nine states to Indian Territory.

The U.S. government initially oversaw the removal, but the conditions were so appalling and the death toll so high that Principal Chief John Ross successfully negotiated for the Cherokee Nation to manage the final stages of the removal. Even under their own supervision, the suffering was immense. Disease, particularly cholera, dysentery, and whooping cough, ravaged the weakened population. Exposure to extreme cold and heat, inadequate food and water, and the sheer exhaustion of the journey claimed countless lives. One soldier, later recalling the horror, reportedly stated, "I fought through the Civil War and saw men shot to pieces and killed by the thousands, but the Cherokee removal was the cruelest work I ever knew."
Of the estimated 16,000 Cherokees who began the journey, approximately 4,000 perished – one-quarter of their entire population. The dead included infants, children, the elderly, and the infirm. They were buried in unmarked graves along the trail, their final resting places often forgotten, a testament to the callous disregard for human life that characterized the removal.
Upon arrival in Indian Territory, the surviving Cherokees faced the daunting task of rebuilding their lives and their nation. The trauma of the removal, coupled with internal strife stemming from the Treaty Party’s actions, led to further violence, including the assassinations of Major Ridge, Elias Boudinot, and other Treaty Party leaders in 1839. Yet, despite these immense challenges, the Cherokee Nation persevered. They re-established their government, rebuilt their farms, schools, and institutions, and once again thrived as a self-governing people.
